In this Privacy Notice (“Notice”), we describe how Lineage Logistics Holdings, LLC, with its headquarters at 46500 Humboldt Drive, Novi Michigan MI 48377, United States of America, and reachable at +1.800.678.7271, together with Lineage’s group companies (whose details can be found here) (“Lineage,” “we,” “us,” or “our”) collects, stores, uses, processes, discloses and transfers information that we obtain about visitors to websites displaying this Notice (each a “Site”), the services we provide to our customers, and information we collect about you offline, such as when you call us (collectively, the “Services”).

For European Users Only: Lineage Logistics Holdings, LLC will be a controller in respect of information collected via the Sites. If relevant, your information will also be shared with your local Lineage group company, who will also act as controller in respect of that information.

Before visiting our Site or engaging with us, or otherwise providing personal information to us, please review this Notice carefully. If you do not wish to have your personal information collected, used, disclosed, or otherwise processed as set forth in this Notice, you must refrain from using our Services or disclosing your personal information to us. Where processing is stated in this notice to be on the basis of consent, we will not collect, use, disclose or process your personal data without first obtaining that consent When used in this Notice, “process”, “processed” and “processing” includes collecting, editing, utilizing, storing, organizing, providing, sharing, deleting, or anonymizing personal information or disseminating it in cyberspace for commercial purposes.

For US Users Only: By visiting the Site, or using any of our Services, you agree that your personal information will be handled as described in this Notice. Your use of our Services, and any dispute over privacy, is subject to this Notice and our Terms and Conditions including its applicable limitations on damages and the resolution of disputes.

For European Users Only: This privacy notice sets out how we will process your personal data collected in connection with the Site. If you engage with us in other ways (for example as a customer, driver, applicant or employee) or via different platforms, you may be provided with additional information as to how your data may be processed which will supplement this privacy notice. Your use of our services is subject to our Terms and Conditions, including its applicable limitation on damages and the resolution of disputes.

The Information We Collect About You

We collect information about you directly from you and automatically through your use of our Services. In some cases this information will be “personal information”, which means any information relating to you or any individual who is identified or identifiable, or information that can be combined with other information to identify a natural person's information, or as defined under applicable law. We do not collect sensitive personal information (or such similar terms as defined in applicable laws) about you under this Notice. If we do collect sensitive personal information, you will be provided with further information about how this is processed.

Information We Collect Directly from You. The information we collect from you depends on how you use our Services. When you sign up to create a Lineage Link® account on our Site, to register as a user, you must provide your name and company email address. To register as a driver, you must provide your name and mobile phone number.

To the extent required or compliant with law, you may also provide your driver’s license number and date of issue and mobile phone number (if registering as a user). When you request a transportation quote, we collect your name, company, email address, phone number, and details about your service. We also collect information directly from you if you inquire about our Services through our Site, subscribe to our newsletter, or otherwise contact us.

Information We Collect Automatically. We automatically collect information about your use of our Site through cookies, web beacons, and other technologies, including: domain name; your browser type and operating system; web pages you view on the Site; links you click on the Site; your IP address; the length of time you visit our Site and use our Services; referring URL; or the webpage that led to our Site. To the extent permitted by applicable law, we combine this information with other information we collect about you, including your personal information. Please see our cookie policy here.

We may ask you to provide certain personal information, and if you choose not to provide us with the requested personal information (for example, if you not provide us with information that is indicated as mandatory), we may not be able to manage your account, provide you with our products or services, or you may not be able to access all of the Site or participate in all of its features. We will inform you where there is a statutory requirement that you provide us personal information, or where personal information is necessary to enter into a contract with you.

How We Use and Process Your Information

We use and process your information, including your personal information, whether in electronic or another form, in accordance with this Notice and for the purposes and on the basis of the legal grounds described below. Where required by applicable laws, we will obtain your consent before using or processing your personal information, or if we wish to use your personal information for purposes other than those stated in this Notice.

  • Service-Related Purposes – Contract Performance. We process personal information on the legal grounds of performing our contract with you or your employer, or taking steps at your request in anticipation of entering into a contract with you or your employer for the following purposes:
    • To provide our Services to you.
    • To respond to your inquiries.
    • To facilitate your ability to use Lineage Link®.
  • Service-Related Purposes – Legitimate Interests. We process personal information on the legal grounds of fulfilling our legitimate interests in improving our Services in order to grow our revenues and our business for the following purposes:
    • To otherwise personalize your experiences while using the Services.
    • To provide our Services to you where they have been contracted by a third party, for example your employer.
    • To respond to your enquiries.
    • To manage billing and other contractual obligations owed to third parties.
  • Marketing Purposes – Consent. If you are a customer or prospect in Asia, or a prospect in Europe, we process personal information on the legal grounds of your consent for the following purposes:
    • To send you email marketing about our products and services and those of our affiliated entities.
    • To send you news and newsletters.
  • Advertising Purposes – Consent. If you are in Asia or Europe, we process personal information on the legal grounds of your consent for the following purposes:
    • To collect information (including personal information) via cookies and other trackers that will assist us in advertising on third party websites, mobile apps, and other online services, and to evaluate the success of our advertising campaigns through third party channels (including our online targeted advertising and offline promotional campaigns).
  • Marketing Purposes – Legitimate Interests. We process personal information on the legal grounds of fulfilling our legitimate interests in improving the return on our marketing communications and increasing our sales and revenues for the following purposes:
    • To send you email marketing about our products and services and those of our affiliated entities.
    • To send you news and newsletters.
    • To assist us in advertising on third party websites, mobile apps, and other online services, and to evaluate the success of our advertising campaigns through third party channels (including our online targeted advertising and offline promotional campaigns).
  • Research, Product Improvement, Enhanced User Experiences – Legitimate Interests. We process personal information on the legal grounds of fulfilling our legitimate interests in improving the return on our marketing communications and improving our Services to increase sales and revenues for the following purposes:
    • To better understand how users access and use our Services, both on an aggregated and individualized basis.
    • For research and analytics purposes.
    • To administer surveys and questionnaires, such as for market research or member satisfaction purposes.

  • Legal Obligation and Protecting Our Rights and Interests – Legitimate Interests. We process personal information on the legal grounds of fulfilling our legitimate interests in complying with laws and defending our employees, our rights, and assets in order to protect our business and reputation for the following purposes:
    • To comply with legal obligations, as part of our general business operations, and for other business administration purposes.
    • Where necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or violations of our Terms and Conditions or this Notice.
    • Where necessary in connection with a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • Legal Obligations under EEA or UK Laws – Compliance with Legal Obligations. We process personal information on the legal grounds of complying with an EEA or UK legal obligation for the following purposes:
    • To comply with EEA or UK legal obligations related to our general business operations and other business administration purposes, namely to comply with tax and accounting regulations, management of regulated haulage, and management of fleet staff.
    • To comply with an EEA or UK mandatory court order, or other legal process, such as in response to a court order or a subpoena.
  • Legal Obligation and Protecting Our Rights and Interests – Legitimate Interests. We process personal information on the legal grounds of fulfilling our legitimate interests in ensuring our business is organized and operating as efficiently as possible for the following purposes:
    • To plan or execute an internal organization of our business, an investment, merger or sale or similar transaction.

For European Users Only: Where the basis of our processing of data above is our legitimate interests, these are balanced against your rights and freedoms This privacy notice sets out how we will process your personal data collected in connection with the Site. If you engage with us in other ways (for example as a customer, driver, applicant or employee) or via different platforms, you may be provided with additional information as to how your data may be processed which will supplement this privacy notice. Your use of our services is subject to our Terms and Conditions, including its applicable limitation on damages and the resolution of disputes.

How We Share Your Information

We may share your information, including personal information, as follows:

  • Service Providers. We may use third parties to help operate this Site and deliver our Services, including sharing your information with service providers that provide services for or through this Site on our behalf. We currently use service providers to assist with IT hosting and similar services, contact management information, and other operational functions.
  • Affiliates. We disclose the information we collect from you to our affiliates or subsidiaries when they have a need to know such information, or act as our service providers.

We also disclose information in the following circumstances:

  • Business Transfers. In connection with an internal reorganization of our business, or (i) if we or our affiliates are or may be acquired by, merged with, or invested in by another company, or (ii) if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company. As part of the foregoing, we may share certain of your personal information with lenders, auditors, and third-party advisors, including attorneys and consultants.
  • In Response to Legal Process. We disclose your information to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • To Protect Us and Others. We disclose your information when we believe it is appropriate to do so to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Notice, or as evidence in litigation in which we are involved.

Where required by applicable laws, we will obtain your consent before sharing your personal information as described above.

Security of My Personal Information

We have implemented reasonable technical, administrative, and physical security measures that are designed to protect the information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Promotional emails

We may send periodic promotional emails to you. You may opt-out of promotional emails by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving promotional emails, we may still send you emails about your account or any services you have requested or received from us. You can also opt-out of promotional emails by adjusting your preferences by signing into your account.

How Long We Keep Your Information

We retain your personal information for the period necessary to fulfill the purposes outlined in this Notice unless a longer retention period is required or permitted by applicable law or to fulfill a legal obligation. Accordingly, we retain personal information for the duration of the applicable statute of limitations in order to resolve queries or disputes or bring or defend claims which we think may arise from time to time during the relevant statute of limitations. In certain cases, legal or regulatory obligations require us to retain specific records (such as haulage records, tax and accounting related records) for a set period of time.

Persons Under 18

Our Services are not designed for persons under 18 years of age. If we discover that a person under 18 has provided us with personal information, we will delete such information from our systems.

Changes to this Notice

This Notice is current as of the Effective Date set forth above. We may change this Notice from time to time, so please be sure to check back periodically. If we make any changes to this Notice, we will post the changes to our Site. Where required by applicable laws we will provide prior notice of material changes to this Notice or seek your consent to those changes. You may continue to use our Services only after you have given your consent thereto.

CALIFORNIA PRIVACY RIGHTS

This section of the Notice provides additional information solely for California residents, as required under the California Consumer Privacy Act of 2018 (“CCPA”) and applies to their “personal information” as defined in the CCPA, whether collected online or offline.

“Personal information” means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). This and any other terms defined in the CCPA have the same meaning when used in this section.

Note, however, that there are a number of exemptions from the application of the CCPA. Other sections of the Notice may still apply in addition to other privacy notices that we may issue addressing our specific relationship with you, including privacy notices that are sent to individuals.

This Notice does not apply to information that is publicly available in government records or personal information we collect in a “business-to-business” (B2B) context. B2B personal information is collected when we engage in a business-to-business transaction or communicate solely in the context of conducting due diligence for, providing or receiving a product or service to or from a company and obtain personal information regarding California residents.

We will provide a separate notice regarding the personal information we collect about job applicants or current or former full-time, part-time, and temporary employees and staff, officers, directors, or owners of Lineage, that is used solely in that context.

CALIFORNIA PRIVACY RIGHTS

If you reside in California, you have the right to:

  • request the deletion of your personal information that we collected.
  • request that we disclose information about our collection and use of your personal information over the past 12 months including:
    • the specific pieces and categories of personal information we collected,
    • what personal information we collect, use, disclose, or sell about you
    • the categories of sources of the personal information we collected about you,
    • our business purpose for collecting the personal information,
    • for each category of personal information, the categories of third parties to whom the personal information was disclosed; and
  • be free from discriminatory adverse treatment for exercising these rights.

In order to protect your privacy and verify your request, we may require additional information from you. Please note that these rights are subject to certain exceptions under applicable law.

We do not sell your personal information, but we may share your personal information in the event Lineage, or substantially all of its assets, is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, or liquidation as part of the evaluation or completion of such transaction.

Shine the Light. California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. GDPR PRIVACY NOTICE

This General Data Protection Regulation (“GDPR”) Privacy Notice is for users in the EU or UK and should be read in conjunction with our Global Privacy Notice, available here, which also includes important information for users in Europe.

Your Rights Regarding Your Personal Information

When the GDPR or the UK Data Protection Act 2018 applies, you may have certain rights with respect to your personal information, subject to conditions and limitation in that legislation:

Transborder Transfers of Your Personal Information

Lineage is a global group of companies. Where personal information is collected via this Site, you are providing your personal information directly to Lineage Logistics Holdings, LLC in the United States.

In certain cases, where your personal information is controlled by Lineage group companies located in Europe, it may also be transferred, used, or stored in the United States by affiliates or subsidiaries or their service providers (as outlined above) when they have a need to know such information or act as service providers, and subject to the laws of the United States. If you reside in the EU or UK, please note that the data protection and privacy laws of the United States are not considered by the European Commission to be as protective as the laws in your country.

We ensure that appropriate and suitable safeguards including EU Standard Contractual Clauses are in place for personal information being transferred to countries where an adequate level of protection is not guaranteed. Where your personal information is shared, transferred or stored in jurisdictions outside of the jurisdiction in which you reside or are located, it may be subject to the laws of such jurisdiction (for example, the laws of the United States). Please note that the data protection and privacy laws of such jurisdiction may not be as protective as the laws in your country or jurisdiction. Where this is the case, we will use reasonable efforts to implement contractual protections for the personal information, as required by applicable laws.

Your Rights Regarding Your Personal Information

In addition to the rights set out in the AsiaPac Privacy Notice below, in certain circumstances under the laws of Vietnam:

  • Access: You have the rights to request provision of a copy of or access to your personal information, which includes the right to obtain confirmation from us as to whether or not personal information concerning you is being processed, and where that is the case, provision of a copy of or access to the personal information, and information related to how it is processed;
  • Re-examine, Update, Correct or Delete: In certain circumstances, you have the right to have us re-examine, update, correct or delete your personal information, which includes the right to have incomplete personal information completed.
  • Stop Sharing or Transfer: You have the right to request that we stop providing your personal information to a third party.

Your exercise of these rights is subject to certain exemptions to safeguard the public interest (e.g. the prevention or detection of a crime), our interests (e.g. the maintenance of legal privilege) or technical reasons. If you exercise any of these rights, we will respond in most cases in a timely manner.

Your Rights Regarding Your Personal Information

Under applicable data protection law, you may have certain rights with respect to your personal information; those rights may include the following:

  • Correct or Delete: In certain circumstances, you have the right to have us correct or delete your personal information, which includes the right to have incomplete personal information completed.
  • Complaints: You have the right to file a complaint with us or a regulator including if you believe that we have breached the privacy law (and in Australia, including the Australian Privacy Principles) . If you file a complaint with us, we will review and respond to your complaint as soon as possible and generally within 30 days of receiving your correspondence. In Australia, if you are disasatisfied with the outcome of your complaint, you may contact the Office of the Australian Information Commissioner whose contain details are available at www.oaic.gov.au
  • Deregistration: You have the right to de-register your account with us at any time.
  • Automated decision making: where applicable, you have the right to object to automated decision making.

Transborder Transfers of Your Information

Lineage is a global group of companies. We may transfer your information to other recipients as noted in our Notice. In certain cases, those recipients may be located in jurisdictions outside of the jurisdiction in which you reside or are located, such as the United States. Where this is the case, we will only do so using a legitimate transfer mechanism as required under applicable laws.

Where your personal information is shared, transferred or stored in jurisdictions outside of the jurisdiction in which you reside or are located, it may the subject to the laws of such jurisdiction (for example, the laws of the United States). Please note that the data protection and privacy laws of such jurisdiction may not be as protective as the laws in your country or jurisdiction. Where this is the case, we will use reasonable efforts to implement contractual protections for the personal information, as required based on the legitimate transfer mechanism used, and in accordance with applicable laws and regulations.

In Australia, Lineage is bound by the Privacy Act 1988 (Ct.) (Privacy Act) and Australian Privacy Principles (APPs) (collectively “Australian Privacy Laws”). If you are in Australia, you acknowledge and agree that:

  • Lineage provides and discloses information to third parties (outside of the Lineage group of companies) located outside of Australia (“overseas recipients”) which are not subject to Australian Privacy Laws.
